Terms and Conditions - Nomara safaris

1. Introduction

These Terms and Conditions govern all bookings made with Nomara Safaris, operated by NEXTO INVESTMENT COMPANY LIMITED, License Number: UTB/RTT/TO/2025/101835.

By confirming a booking with Nomara Safaris, you agree to be bound by these Terms and Conditions.

2. Booking & Confirmation

  • A booking is confirmed once a written confirmation is issued and the required deposit is received.

  • Gorilla trekking permits and certain accommodations require full advance payment to secure availability.

  • Bookings are subject to availability at the time of confirmation.

3. Payments

3.1 Booking Deposit

When you make a booking with Nomara Safaris, a deposit of 50% or 100% of the safari cost is required, depending on the nature of the safari. The exact deposit percentage will be stated in your invoice. The deposit confirms your booking and secures permits, accommodations, and other arrangements.

Certain services require 100% payment upfront, including:

  • Gorilla and chimpanzee permits in Uganda and Rwanda

  • Internal flights

  • Bookings during peak holiday periods

Group bookings may also require an additional deposit as indicated in your quotation.

3.2 Balance Payment

The remaining balance must be paid 45 to 20 days prior to your safari departure, depending on your booking and permit requirements. Failure to pay the balance by the due date may result in cancellation of your trip, in which case the deposit may be forfeited unless otherwise agreed.

3.3 Late Payments & Reminders

If a payment is overdue, Nomara Safaris will send a reminder. If the balance is not received promptly, we reserve the right to cancel your travel arrangements. Any cancellation due to late payment will follow the refund and cancellation policies stated in these Terms and Conditions.

3.4 Price Validity & Currency

All quotes provided are valid for seven (7) days from the date issued. After this period, prices may be subject to change due to variations in supplier rates or currency fluctuations.

All pricing is quoted in US dollars (USD) unless otherwise specified. Clients are responsible for any bank or currency exchange fees incurred during payment.

3.5 Government Permit Fees

Gorilla, chimpanzee, and other wildlife permits are issued and regulated by the relevant government authorities. Nomara Safaris acts as an agent in securing these permits. Any changes in government fees or administrative policies may affect the total cost of your safari, and you will be informed of any adjustments prior to final payment.

4. Cancellations & Refund Policy

Cancellation charges apply as follows (unless otherwise stated in writing):

  • 60+ days before arrival: Deposit may be partially refundable (excluding permit costs).

  • 30–59 days before arrival: 50% of total cost may be charged.

  • Less than 30 days before arrival: 100% cancellation fee may apply.

Gorilla permits are non-refundable once issued, as per government regulations.

All cancellations must be submitted in writing.

5. Changes & Amendments

Any changes requested after confirmation are subject to availability and may incur additional costs.

Nomara Safaris reserves the right to make minor adjustments to itineraries due to weather, road conditions, park regulations, or operational reasons.

6. Travel Insurance

All travelers are strongly advised to obtain comprehensive travel insurance covering:

  • Trip cancellation

  • Medical emergencies

  • Emergency evacuation

  • Personal belongings

  • Travel delays

Nomara Safaris shall not be responsible for losses resulting from failure to obtain adequate insurance.

7. Health & Travel Requirements

Clients are responsible for ensuring they meet all:

  • Passport validity requirements

  • Visa requirements

  • Vaccination and health regulations

Vaccination recommendations (including Yellow Fever) vary by country and nationality. Clients should consult their medical provider before travel.

8. Liability

Nomara Safaris acts as a tour operator organizing services including accommodation, transportation, and activities.

While we take every reasonable step to ensure safety and quality, Nomara Safaris shall not be held liable for:

  • Injury, illness, or death

  • Loss or damage to personal belongings

  • Delays caused by weather, natural disasters, political events, or force majeure

  • Actions or omissions of third-party service providers

Participation in safari activities involves inherent risks, including wildlife encounters.

9. Force Majeure

Nomara Safaris shall not be liable for failure to perform obligations due to circumstances beyond reasonable control, including:

  • Natural disasters

  • Government restrictions

  • Epidemics or pandemics

  • Civil unrest

  • Acts of God

In such cases, alternative arrangements or credits may be offered where possible.

10. Complaints

Any complaints must be reported immediately to your guide or company representative during the safari to allow prompt resolution.

If unresolved, complaints must be submitted in writing within 14 days of completion of travel.

11. Governing Law

These Terms and Conditions are governed by the laws of the country in which NEXTO INVESTMENT COMPANY LIMITED is registered which is Uganda.

12. Privacy & Data Protection

Nomara Safaris, operated by NEXTO INVESTMENT COMPANY LIMITED, respects your privacy and is committed to protecting your personal information. We collect only the information necessary to process bookings, secure permits, arrange accommodations and transportation, and communicate important travel details.

Your information may be shared with trusted service providers (such as lodges, airlines, and park authorities) strictly for operational purposes. We do not sell or trade your personal data.

All reasonable measures are taken to safeguard your information. By booking with us or submitting an inquiry, you consent to the collection and use of your information as outlined above.
